What if a group is incorporated in Delaware?

Many groups choose to incorporate in Delaware and other states due to taxation benefits and other reasons. California carriers do not have any issues with groups being incorporated outside of California, however, all California carriers require groups to be filed with the Secretary of State of California (Corp, LLC, LP) for them to apply for California benefits. Filing in California allows a group to transact business in the state. 

To check if a group is filed to do business in California, check the Secretary of State of California website and use the Business Search feature.
