Health Net Will Submit All Gag Clause Prohibition Compliance Attestations

The Consolidated Appropriations Act, 2021 (P.L.116–260) requires health plans to submit an annual Gag Clause Prohibition Compliance Attestation (GCPCA).
What You Need to Know
- The initial filing was due December 31, 2023.
- Ongoing attestations are due each year by December 31.
- Health Net will complete and submit all GCPCA filings on behalf of fully insured groups.
- Employers with fully insured coverage do not need to take any action and will not incur any fees.
- Self-funded plans, including Level Funded plans, are responsible for their own attestations (typically handled by the third party administrator). Health Net does not currently administer self-funded or Level Funded plans in California.
No action is required from employer groups. Health Net will submit all required attestations. A confirmation notice will be shared with brokers after the December 31st filing deadline.
